一、定义
为便于阅读，本条款中使用的术语含义如下： · "本服务"：指由我们提供的撩5分多人在线桌游平台，包括其客户端、服务器及相关功能。 · "用户"或"您"：指阅读、注册或使用本服务的自然人。 · "账号"：指您注册并通过电子邮箱与密码登录使用的账户。 · "积分"：指本服务内的虚拟计分单位，仅用于显示游戏成绩，无任何现实价值。 · "内容"：指您在本服务中提交、发布、显示的任何信息（包括但不限于昵称）。
二、严禁赌博 · 重要声明
本服务是一款仅供娱乐的休闲桌游，严格禁止任何形式的赌博活动。 （一）严禁的行为包括但不限于： · 以现金、转账、红包、虚拟货币、礼品卡、实物或任何具有经济价值的标的作为筹码或奖励； · 以游戏胜负、积分高低作为收取、支付报酬或结算债务的依据； · 组织、招揽、参与任何形式的赌局； · 通过线下方式（如微信群、QQ 群）将本服务用作赌博工具。 （二）法律风险与责任承担： 用户违反上述规定的，由此产生的一切法律责任、经济损失、行政处罚、刑事追究及其他后果，均由违规用户自行承担。我们及本运营者不承担任何法律或经济责任，亦不参与此类争议的调解或处理。 （三）我们的处置措施： 一经发现或经举报核实违规行为，我们有权立即采取以下一项或多项措施： · 永久封禁相关账号，且不予退还任何已支付费用（如有）； · 删除违规内容； · 向监管机关、公安机关报告并提交相关数据，依法配合调查。 （四）举报渠道： 如发现他人利用本服务进行赌博活动，欢迎通过 legal@bidfive.com 举报。
三、账号注册与安全
（一）注册条件： · 您必须已年满 18 周岁，并具有完全民事行为能力； · 您应使用真实、准确、完整的注册信息（电子邮箱）； · 一个邮箱只能注册一个账号。 （二）账号安全： · 您应妥善保管账号密码，对所有以您账号进行的操作负责； · 因密码泄露、账号被盗造成的损失由您自行承担，但有证据证明系本服务原因的除外； · 发现账号异常应立即通过 legal@bidfive.com 联系我们冻结或重置； · 您不得将账号转让、出借、出售给他人，否则我们有权封禁。 （三）账号注销： · 客户端的"退出登录"仅清除本地登录态，账号与数据保留； · 如需彻底注销账号，请进入「我的」→「删除账户」，输入当前密码并完成确认后即时生效。注销后您的邮箱、昵称、头像、密码立即被永久清除，已发出的登录令牌即时失效；为保留其他玩家的战绩完整，过往对局记录将以匿名身份保留。该操作不可恢复；如需重新使用本服务，需用其他邮箱重新注册； · 如您无法登录或客户端不可用，可发邮件到 legal@bidfive.com 由我们协助处理。
四、用户行为规范
您在使用本服务期间应遵守中华人民共和国法律法规及社会公德，不得从事下列行为： （一）技术滥用： · 利用程序漏洞、外挂、自动化脚本、机器人等不正当手段获取游戏优势； · 通过技术手段攻击、入侵或干扰服务器、网络与其他用户的正常使用； · 反向工程、破解或修改本服务的客户端代码。 （二）内容禁止： · 发布或在昵称中包含违反法律法规、危害国家安全、煽动民族仇恨、宣扬暴力、色情、赌博、迷信、邪教等内容； · 发布或在昵称中包含侮辱、诽谤、骚扰、威胁、侵犯他人隐私或知识产权的内容； · 冒充他人或机构，进行欺诈活动。 （三）赌博相关： 禁止任何形式的赌博活动（详见第二条）。 违反上述规定的，我们有权立即采取警告、限制功能、封禁账号、删除内容等措施，并配合监管机关与司法机关调查；情节严重者将依法追究法律责任。
五、用户内容
· 您对您在本服务中提交的内容（如昵称）保留全部知识产权，但您授予我们一项免费的、非独家的、全球范围的许可，用于在提供本服务所必需的范围内使用、存储、显示、传输上述内容。 · 您应对您所提交内容的合法性、真实性负责，并承诺不侵犯任何第三方的合法权益。 · 我们有权对违反法律法规或本条款的内容进行删除、屏蔽或修改，并保留追究责任的权利。
六、知识产权
本服务及其相关的全部内容（包括但不限于客户端代码、服务端代码、界面设计、文字、图标、商标、标识、音视频、游戏规则的具体表达），其知识产权均归本运营者或相关权利人所有，依法受著作权法、商标法、专利法、反不正当竞争法等法律保护。 未经我们事先书面许可，您不得： · 复制、修改、改编、翻译、传播本服务的任何部分； · 对本服务进行反向工程、反向汇编、反向编译； · 以本服务为基础开发衍生产品并发布； · 将本服务用于任何商业用途。
七、服务变更与中止
· 我们可能因业务调整、技术升级、设备维护、系统故障、不可抗力等原因，对本服务的部分或全部功能进行变更、暂停或终止，且无需事先通知； · 我们可能在本服务中下线、删除部分功能或对功能进行调整，对此不构成对您的违约； · 在本服务终止时，我们将以适当方式提前告知，并在合理期限内为您提供数据导出或注销账户的便利； · 因不可抗力（如自然灾害、战争、政府行为、电信故障、黑客攻击）导致服务中断的，我们不承担违约责任。
八、免责与责任限制
（一）服务按"现状"提供：我们不就服务的及时性、安全性、准确性、稳定性、完整性作出任何明示或暗示的保证。 （二）我们不对下列情形造成的损失承担责任： · 因您未按本条款使用本服务造成的损失； · 因您将账号告知他人或与他人共享造成的损失； · 因不可抗力或第三方原因造成的服务中断或数据丢失； · 因您违反法律法规（包括但不限于第二条规定的赌博禁令）造成的任何后果。 （三）责任限制：在法律允许的最大范围内，我们对您因使用或无法使用本服务所产生的任何直接、间接、附带、特殊、惩罚性损失不承担责任。如本服务被法定主管机关认定我们应承担责任的，赔偿总额不超过您在过去 12 个月内向本服务实际支付的费用（如有）。
九、条款的修改与终止
· 我们可能根据法律法规变化或业务需要不定期修订本条款，修订版本将通过客户端公告并更新页眉版本号。 · 一般性修订自公告之日起 7 日后生效；涉及您重大权利的修订，将以站内信、邮件或弹窗等显著方式告知，并征得您的再次同意。 · 您不同意修订后条款的，应立即停止使用本服务并注销账号；继续使用即视为接受修订。 · 您违反本条款时，我们有权随时终止向您提供服务，并保留追究法律责任的权利。
十、适用法律与争议解决
· 本条款的订立、效力、履行、解释及争议解决，均适用中华人民共和国法律（不含港澳台地区法律）。 · 因本条款引起或与本条款相关的任何争议，双方应首先通过友好协商解决；协商不成的，任何一方均有权向依法有管辖权的人民法院提起诉讼。 · 本条款任何条款的全部或部分被认定为无效或不可执行的，不影响其他条款的效力，双方应协商以最接近原意的有效条款替代之。 · 本条款的最终解释权在法律允许的范围内归本运营者所有。
Terms of Service
1. Definitions
For ease of reading: · "Service" means the BidFive multiplayer card-game platform we provide, including the client app, servers, and related features. · "User" or "you" means any natural person who reads, registers, or uses the Service. · "Account" means the account you register with via email and password. · "Points" means the in-game scoring units that have no real-world value. · "Content" means any information you submit, post, or display in the Service (including nicknames).
2. No Gambling — Important Notice
The Service is a casual card game for entertainment only. Any form of gambling is strictly prohibited. (a) Prohibited conduct includes (without limitation): · Using cash, transfers, red-packets, virtual currency, gift cards, items, or anything of economic value as stakes or prizes; · Using game outcomes or scores to settle payments or debts; · Organizing, soliciting, or participating in any gambling group; · Using the Service as a gambling tool via off-platform means (e.g. WeChat or QQ groups). (b) Legal risk and responsibility: If a user violates the above, all legal liability, financial loss, administrative penalty, or criminal consequence shall be borne solely by the violating user. We and the Operator bear no legal or financial responsibility, nor will we mediate or participate in such disputes. (c) Our enforcement actions: Upon discovery or verification of violation, we may take one or more of the following: · Permanently ban the account, with no refund of any fees paid (if any); · Remove violating content; · Report to and provide data to regulators or police as legally required. (d) Reporting: If you observe others using the Service for gambling, please report to legal@bidfive.com.
3. Account & Security
(a) Eligibility: · You must be at least 18 years old and have full civil capacity; · Registration information (email) must be true, accurate, and complete; · One email may register only one account. (b) Account security: · You are responsible for safeguarding your password and for all activity under your account; · Losses caused by password disclosure or account compromise are your responsibility, unless caused by us; · Contact legal@bidfive.com immediately to freeze or reset upon any anomaly; · You may not transfer, lend, or sell your account; we may ban such accounts. (c) Account closure: · The "Logout" button in the client only clears the local session — your account and data remain; · To permanently close your account, go to Profile → Delete Account, re-enter your current password, and confirm. The action takes effect immediately. Your email, nickname, avatar, and password are permanently erased and any issued login tokens are invalidated; past match records are retained in anonymized form to preserve the integrity of other players' history. The action is irreversible; to use the service again you must register with a different email; · If you cannot log in or the client is unavailable, email legal@bidfive.com and we'll assist.
4. User Conduct
You agree to comply with applicable laws and public morals. You shall not: (a) Technical abuse: · Use cheats, bots, automation, or other unfair means to gain advantage; · Attack, intrude on, or interfere with servers, networks, or other users; · Reverse-engineer, crack, or modify the client. (b) Prohibited content: · Post or use as a nickname any content that violates law, endangers state security, incites hatred, or promotes violence, pornography, gambling, superstition, or cults; · Insult, defame, harass, threaten, or infringe the privacy or IP rights of others; · Impersonate others or commit fraud. (c) Gambling-related: No gambling activities of any kind (see Section 2). Violation may result in warning, feature limitation, account ban, content removal, and cooperation with regulators or law enforcement; serious cases may be pursued legally.
5. User Content
· You retain ownership of any content you submit (e.g. nicknames), but grant us a free, non-exclusive, worldwide license to use, store, display, and transmit it as necessary to operate the Service. · You are responsible for the legality and truthfulness of submitted content and warrant that it does not infringe any third party's rights. · We may remove, hide, or modify any content that violates law or these Terms, and reserve the right to pursue further remedies.
6. Intellectual Property
All intellectual property in the Service (including the client and server code, UI design, text, icons, trademarks, audio/video, and the specific expression of game rules) belongs to the Operator or relevant rights holders, protected by copyright, trademark, patent, and unfair-competition laws. Without our prior written consent you may not: · Copy, modify, adapt, translate, or distribute any part of the Service; · Reverse-engineer, decompile, or disassemble the Service; · Develop derivative products based on the Service; · Use the Service for any commercial purpose.
7. Service Changes & Suspension
· We may modify, suspend, or terminate part or all of the Service due to business adjustments, technical upgrades, maintenance, system failure, or force majeure, without prior notice; · We may discontinue or adjust features; this does not constitute a breach; · Upon termination, we will give reasonable notice and provide a reasonable window for data export or account closure; · We are not liable for service interruption due to force majeure (e.g. natural disaster, war, government action, telecom failure, hacker attack).
8. Disclaimers & Limitation of Liability
(a) "As-is" provision: we make no express or implied warranty regarding timeliness, security, accuracy, stability, or completeness of the Service. (b) We are not liable for losses caused by: · Your failure to use the Service per these Terms; · Sharing or disclosing your account to others; · Force majeure or third-party causes resulting in service interruption or data loss; · Your violation of law (including the no-gambling rule in Section 2). (c) Liability cap: to the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, or punitive damages arising from your use or inability to use the Service. Should a competent authority require us to compensate, total compensation shall not exceed the fees you actually paid to the Service in the prior 12 months (if any).
9. Modification & Termination of Terms
· We may revise these Terms as laws or business needs change. Revisions are posted in-client and the version number in the header is updated. · Routine revisions take effect 7 days after publication; revisions affecting your significant rights will be highlighted via in-app message, email, or modal, and your renewed consent will be sought. · If you do not agree, stop using the Service and close your account; continued use is deemed acceptance. · If you breach these Terms, we may terminate the Service to you at any time and reserve the right to pursue legal action.
10. Governing Law & Disputes
· These Terms are governed by the laws of the People's Republic of China (excluding Hong Kong, Macau, and Taiwan), and apply to all disputes arising out of or related to these Terms. · Disputes shall first be resolved by friendly negotiation; failing that, either party may bring suit in a court with competent jurisdiction. · If any provision is held invalid or unenforceable in whole or in part, it does not affect the remaining provisions; the parties shall negotiate in good faith to replace the invalid provision with a valid one closest to the original intent. · To the extent permitted by law, the Operator reserves the right to interpret these Terms.
